In the European Union, each member state requires companies to declare hazardous chemical mixtures placed on the market. This obligation, defined by Article 45 of the CLP Regulation, aims to provide poison control centers with accurate information for rapid emergency response.
With Annex VIII of the CLP Regulation, the EU harmonizes notification procedures, imposing strict requirements on importers and downstream users. Since January 1, 2021, companies must submit their declarations via the ECHA PCN portal according to a regulatory timeline:
- January 1, 2021: Mixtures intended for consumers and professionals
- January 1, 2024: Mixtures for industrial use
- January 1, 2025: Obligation extended to all formulas placed on the market before 2024
Non-compliance with these obligations can result in sanctions, including fines and the withdrawal of your products from the market.
